
TERMS AND CONDITIONS
At Warwickshire Party Hire, we prioritise the safety of our customers and want to ensure that everyone has a great experience using our service. We kindly request that you carefully read and sign our Hire Agreement before proceeding with booking our equipment.
1. GENERAL
For the purposes of this contract:
- This contract is for the hire of items and accessories. Including the sale of goods and services. "Equipment"
- The person(s), company or other organisation hiring the equipment or purchasing goods. "hirer" "hirer's"
- Any condition deemed invalid will not affect other conditions. Nothing in the Contract will limit a consumer's existing legal rights.
- Extent of Contract and Cancellation. The Contract is not assignable. It becomes effective when Warwickshire Party Hire accepts the Hirer's detailed order.
- This agreement ruled by and constructed under the laws of England. The parties hereto submit the exclusive jurisdiction of the English Courts.
- Warwickshire Party Hire reserves the right to make reasonable amendments to this contract. Without giving notice to the other party or parties.
2. OWNERSHIP OF EQUIPMENT AND GOODS
- Any equipment you hire remains the property of Warwickshire Party Hire at all times.
- The ownership of any goods you purchase from us transfers only after full payment is made by you.
3. LOSS OF EQUIPMENT
- Warwickshire Party Hire will treat equipment unavailable for inspection and collection as lost.
- You will pay a penalty charge for equipment replacement equivalent to the replacement value and lost revenue for the total cost of existing future dated bookings that are unable to be met.
- You will also pay £20 per day + the daily hire charge starting from the day of the hire until Warwickshire Party Hire receive the penalty charge and associated costs.
4. SECURITY OF EQUIPMENT
- The hirer accepts responsibility for equipment security until collection by Warwickshire Party Hire.
- The hirer agrees not to sell or relinquish possession, alter, repair or change equipment in any way.
5. HIRE FEES
- Our minimum hire fee does not include overnight fees, multi-day bookings or delivery charges.
- All prices shown on product pages relate to a single day's booking.
- Overnight fees are charged at 50% of the day rate with items being collected the following morning.
- Multi-day bookings are charged at the day rate shown on the product page, multiplied by the number of days required.
- Multi-day bookings do not carry an overnight fee.
6. PAYMENT
- Bookings require a deposit of no less than 20% of the total booking value which must be paid at the time of booking prior to the order being confirmed.
- Deposits are non refundable unless otherwise stated.
- All outstanding balances must be made in full, prior to or upon delivery commencing on the hire date. A hire will not be completed unless payment has been made.
- Warwickshire Party Hire reserves the right to cancel any booking where the deposit or full balance is not paid within the timescales stated.
7. DELIVERY AND COLLECTION
- Delivery and collection times are approximate. Warwickshire Party Hire will always endeavour to arrive on or by the times shown on the booking. We will attempt to call you should we be running more than 10 minutes late for either delivery or collection.
- Warwickshire Party Hire cannot be held liable for any additional costs incurred by the hirer should we arrive at times differing those shown on the booking.
- The hirer must ensure all hire items are available for collection, by the agreed collection time.
- The hirer must not allow any items to be partially or fully packed away by anyone other than a Warwickshire Party Hire team member. All hired items need to be inspected by a Warwickshire Party Hire team member on arrival, before packing away can commence. Any damage caused by a 3rd party in attempting to pack away equipment will be charged in line with the damage fees stated.
8. REQUIRED SPACE
- It is the responsibility of the hirer to ensure there is:
- Safe, sufficient and suitable access for Warwickshire Party Hire to enter and leave the area where hired items are to be situated.
- Safe, sufficient and suitable space for hired items to be set up. I.e. clean, flat and level, and free of anything that could cause harm or damage to our hire items, or harm to any person.
- We are unable to provide our items to public land, communal land, or areas such as gardens shared by flats without the express written consent of the landowner on headed paper displaying their full contact details.
- We are also unable to provide items to council-owned land or privately owned land etc, without the express written consent of the landowner on headed paper displaying their full contact details.
- The written consent must be provided to Warwickshire Party Hire at the time of booking or no later than 14 days in advance of your event date.
9. INSTALLATION
- Warwickshire Party Hire require the hirer to be present for the delivery of all hired items so they can inspect the cleanliness, condition and repair of the items supplied, and to receive any necessary instructions and/or safety briefing.
- Hired items will not be installed until full payment has been made in full.
- he hirer can nominate a person to take delivery of hired items on their behalf, by providing an email, sent from the email address shown on the booking, naming the nominated person.
- The responsibility of the booking will remain with the hirer.
10. CANCELLATION POLICY
At Warwickshire Party Hire, we understand that circumstances can change and you may need to cancel or modify your booking with us. Our cancellation policy below outlines the important details, including any applicable fees or refunds.
Please note that this cancellation policy applies to all bookings.
Cancellation by Warwickshire Party Hire
It is very rare for us to have to cancel a booking, however some circumstances may arise such as:
- If we are forced to cancel due to reasons beyond our control e.g a vehicle breakdown, equipment failure or theft, staff shortage or any other unforeseen situation, a full refund of all payments received will be made or alternative arrangements for a different date or time can be made with no charge.
- If we are forced to cancel due to a failure on the part of our customer to make sure the site is suitable for our products e.g lack of space, unsuitable surface, narrow gates or paths, dangerous obstacles or animal fouling, the client will be liable for the full cost of the booking with no option to transfer the booking to another date or time. Responsibility to ensure the site is suitable rests entirely with the person making the booking. If in doubt, please ask us before the booking.
- If we are forced to cancel due to failure on the part of the hirer to provide accurate or truthful information relating to the delivery address, intended use, intended users or intended surface type, the customer will be liable for the full cost of the hire with no option to transfer the booking to another date or time. The hirer must provide accurate and honest information when making the booking.
- In the event that an adult 18 years of age or older is not present at the time of delivery to accept responsibility for the equipment.
- In the event of bad weather (regards to our Adverse Weather Policy), we will offer you the opportunity to move your booking indoors or to another day no later than 3 months after the original hire date. If you decide not to reschedule your booking there will be no refunds issued.
Cancellation by the Client
We recognise that circumstances can change and it may be necessary for a customer to cancel their booking. Any cancelled orders are subject to the following cancellation charges:
- More than 14 days prior to the event date, refund of no more than 80% of booking total will be given or the chance to change the date within 3 months of original hire date.
- Within 14 days prior to the event date no refunds in part or full will be given.
Our Adverse Weather Policy supersedes the above Cancellation Policy.
11. ADVERSE WEATHER POLICY
In the event of severe / extreme weather such as high winds, heavy rain or blistering heat we may need to cancel your booking for the safety of users, the general public or our staff. We allow inflatables to be outside even if it is raining. We will discuss with you, the hirer on the day as to whether we feel the current weather is suitable for our equipment. We will try to delay our set up or make our collection earlier if possible to avoid the showers. Our decision is final as to whether it is unsuitable, changing the delivery address to an indoor space may result in a delivery charge. If cancellation is made by the hirer, no refunds in part or full will be given.
- Heavy rain or consistent rain all day may result in cancellation by us. You will be offered the chance to reschedule your booking for a new date no later than 3 months after the original hire date. No refunds in part or full will be given.
- High winds predicted to be over 24mph will result in a cancellation by us. Our decision is final as to whether it is unsuitable, changing the delivery address to an indoor space may result in a delivery charge. Should no alternative venue be available, you will be offered the chance to reschedule your booking for a new date no later than 3 months after the original hire date. No refunds in part or full will be given.
- Risk assessed areas for wind / heavy rain. In some cases we maybe able to deliver the equipment even if the predicted forecast shows extreme weather, each venue will be assessed case by case. Example of areas which can be risk assessed. If the predicted weather states rain but it is not raining or areas which are overly sheltered by high hedges or buildings protecting against the wind.
12. CHANGES TO BOOKINGS
Any changes resulting in removing a product or changing the date may still result in additional charges.
Changes to date:
- Change of date made more than 14 days prior to the event date will result in no additional fee.
- Within 14 days prior to the event date are subject to cancellation only and must be paid for in full before making a new booking on the desired date.
Changes to products:
- Removal or exchange of items with more than 14 days before the hire date resulting in the total balance being less than the original balance will be charged at 50% of the price difference.
- Removal or exchange of items with less than 14 days before the hire date resulting in the total balance being less than the original balance will be charged at 100% of the price difference.
All cancellations or changes to bookings must be notified by email. Phone calls and voicemail messages will be followed up with an email to confirm and must be responded to. If no response, bookings will not be cancelled and our Cancellation Policy will continue to apply. To verify the validity of cancellations or changes, all notification must be made using the same email address used when the booking was made.
13. ADDITIONAL CHARGES UNRELATED TO CANCELLATION
Should the power source be more than 25m away from the rear of the hired item, and not prior agreed, an additional charge of £125 for the hire of a generator will be applied.
Should there be any delay to our schedule upon delivery or collection due to hirer error e.g. restricted access or no answer at the venue, additional charge of £35 plus £20 for every 15 minutes will be applied.
14. ACCIDENT, INJURY OR LOSS
- Warwickshire Party Hire will accept no liability for any accident, injury, loss or death, howsoever caused, in the absence of negligence by Warwickshire Party Hire.
- As hired items will be in the possession and control of the hirer, any liability for accidents, injuries, or other losses, rests with the hirer. It is strongly recommended that the hirer has adequate public liability insurance covering their liability arising from the use of items hired from Warwickshire Party Hire.
15. MEDICAL CONDITIONS
- Warwickshire Party Hire accept no liability for any pre-existing medical condition being made worse through the use of items hired from Warwickshire Party Hire.
- Warwickshire Party Hire recommends any person who feels generally unwell, has a heart condition, is pregnant, is on any medication, or has any physical impairment that could be made worse by using Warwickshire Party Hires hired items, should consult their doctor or consultant and gain their written approval before using any of Warwickshire Party Hires items.
16. APPLICABLE FOR HIRE OF ANY EQUIPMENT
- It is the responsibility of the hirer to ensure that all possible steps are taken to avoid injury to users or damage to our equipment.
- A responsible adult must closely supervise the hired equipment at all times. If a responsible adult is unable to supervise, we can supply staff at £35 per hour at a minimum of 4 hours (if available).
- No adults are allowed to use the hired equipment unless you have hired an adult grade piece of equipment. The equipment has an age limit of 12 years inclusively or user maximum height/size as stated on the item.
- Always ensure that the hired equipment is not overcrowded and limit numbers according to the age and size of children using it as stated on each applicable item. It is advised that children of mixed ages should not use the hired equipment at the same time where injury could occur.
- Do not allow children or adults to become boisterous, push, collide, fight or behave in a manner likely to injure or cause distress to others.
- To avoid choking and mess, no food, drinks or chewing gum to be allowed on or near the hired equipment.
- All footwear, glasses, jewellery or any other hard, sharp or dangerous objects which could cause damage to other children or the equipment must be removed before using the hired equipment. Any damage will be charged at £100 plus full cost of repair.
- No face paints, party poppers, streamers, art supplies or silly string to be used either on or near the hired equipment. A cleaning charge of £35 per hour (quoted at time of collection) will apply if the equipment is returned damaged/soiled.
- No smoking, pets or barbeques on or near the hired equipment.
- No person(s) shall be permitted to partake in the use of any hired equipment whilst under the influence of alcohol, drugs and/or any other intoxicating substance.
- We are insured with full public liability insurance against the failure of our hire equipment only, any claim is subject to an excess which the hirer would be liable for.
- It is the responsibility of the hirer to check the dimensions of the equipment and ensure it can be safely assembled in their chosen location. The hirer must ensure suitable access exists for the delivery and collection of the equipment and a power point (if applicable) is located no more than 25 meters away.
17. APPLICABLE SPECIFICALLY FOR HIRE OF INFLATABLE EQUIPMENT
- Climbing, hanging or sitting on walls or beams of an inflatable is dangerous and must not be allowed.
- Do not allow anyone to bounce on the front safety step as a user could easily bounce off the step resulting in injury. The step is there to assist users getting on and off.
- Ensure that no one with a history of back or neck problems is allowed to use the inflatable equipment as indeed any child who is feeling unwell or taking medication.
- Do not switch off the inflatable if it rains. This prevents the items becoming flooded and unusable for the rest of your event. All electrical components are waterproof.
- Do not allow anyone to be on the inflatable during inflation or deflation or whilst deflated.
- Please warn children of the tie down points (if appropriate) and make the area behind the unit, where the electrical blower is sited, out of bounds for children.
- The inflatable should not be used if it becomes wet on the jumping area. If no shower cover is fitted and in the event of rain, the inflatable should not be used. Any wetness, including bubbling (which is normal) can be dried with a towel once it has stopped raining.
- Should the equipment fail for any reason, please ensure all users get off the inflatable immediately and calmly.
- No unauthorised person should move the bouncy castle, tamper with the electrical equipment or anything else which is designed for safety / the function of the equipment.
- The inflatable must be kept in an acceptable condition, i.e. clean, unsoiled and undamaged. If it is badly soiled or damaged the hirer will be expected to pay an additional charge to cover the cleaning costs and our loss of earnings if the inflatable is rendered out of commission for any reason.
- It is strictly prohibited for both children and adults to be using the inflatables simultaneously where injury could occur.
18. ANCHORAGE
Grass / Soil
As standard we expect to anchor all outdoor inflatables on a grass or soil area. The surface must be firm without the risk of our anchor stakes to come loose during general use. Warwickshire Party Hire and any affiliate reserves the right to refusal of set up if the area is deemed unsuitable. Warwickshire Party Hire does not supply items outdoors on any other substrate than grass (not artificial) or soil.
The European standard 4.2.1 Anchorage
The inflatable shall be provided with an anchorage and/or ballast system and any necessary accessories enabling the inflatable to be securely fixed to the ground. Each inflatable shall have at least six anchorage points. The number of anchorage points shall be calculated in accordance with Annex A. They shall be distributed around the perimeter of the inflatable (see also 4.2.3) and shall be fitted with metal ends. The maximum wind speed in which inflatables shall be used outdoors is 38 km/h (Force 5 on the Beaufort Scale); see Annex B. When used outdoors, the inflatable shall be secured to the ground, preferably with ground stakes where the ground is suitable. Each anchorage point on the inflatable and all of the components of the anchorage and/or ballast system, e.g. ropes, webbings, metal attachments, stakes, weights, shall withstand a force of 1 600 N. The direction of the exerted force shall be at an angle to the ground of 30° to 45°. Ground stakes shall incline away from the direction of the exerted force. Ground stakes shall be a minimum of 380 mm in length and a
minimum of 16 mm in diameter and their tops shall be rounded. The system shall expose no more than 25 mm of the stake above ground level (see Figure 3). When the inflatable is used indoors, the anchorage and/or ballast system should be used, when necessary, to maintain stability. There is no minimum requirement for force resistance indoors.
19. LIMITATION OF LIABILITY
The liability of Warwickshire Party Hire for claims made by the Hirer does not extend to any unforeseeable financial loss caused by late or non-delivery of Equipment or Goods, unsuitability, breakdown, stoppage or lawful repossession.
